Social Security Disability Lawyers Serving Utah
Dealing with a disability that keeps you from working is stressful enough without also facing a confusing federal claims process. Social Security Law Group has represented disability claimants nationwide for more than 30 years, with a 97% win rate and over 55,000 clients helped. Utah residents working with us get licensed attorneys who understand the state’s claims system and know how to build a case that holds up at every stage. Here’s what we handle:
- SSDI Claims: Social Security Disability Insurance is tied to your work history. If you’ve earned enough work credits through Social Security-taxed employment and now have a medical condition that prevents you from working, your income and assets have no bearing on eligibility. We help Utah applicants document their work history and medical condition thoroughly from the first filing.
- SSI Claims: SSI doesn’t require any work history, but it does come with strict income and resource limits. It’s designed for people with a qualifying disability and limited financial means. Our attorneys review your finances against SSI’s thresholds before you apply, so there are no surprises.
- Survivor and Widow’s Benefits: If your spouse paid into Social Security and has since passed away, you may qualify for reduced retirement benefits starting at age 60, or disability-based survivor benefits as early as 50. Those caring for a deceased worker’s disabled child may also qualify at any age. These benefits are commonly overlooked simply because people don’t realize they exist.
- Medicare Enrollment: Approval for SSDI or SSI usually means Medicare eligibility follows, but enrolling comes with its own paperwork and deadlines. We help clients get properly set up without unnecessary delays.
Appealing a Denial in Utah
Most initial applications in Utah are denied, and most reconsiderations are denied again, so a “no” from the SSA is far from the final word. Here’s what the appeals process looks like:
- Reconsideration: A different DDS examiner reviews your entire file again, along with any new evidence you’ve submitted, and issues a fresh decision.
- ALJ Hearing: Nearly all Utah claimants have their hearing through the Salt Lake City hearing office, though claimants in the far southern part of the state, around St. George, are sometimes routed instead to the Las Vegas hearing office. This is where most successful Utah claims are ultimately won, since you can testify directly and respond to a vocational expert’s opinion. You’ll generally have 60 days from your reconsideration denial to request this hearing.
- Appeals Council: If the ALJ rules against you, the Appeals Council can review that decision, reverse it and award benefits, or send the case back for a new hearing.
- Federal Court: If the Appeals Council declines to intervene or rules against you, your final option is filing a lawsuit against the SSA in the U.S. District Court for the District of Utah. Our attorneys represent clients through this stage when it’s necessary.
Why Utah Claimants Trust Social Security Law Group
Utah’s hearing-stage approval rate has historically run higher than a lot of applicants expect, which makes a well-documented case at that stage especially worthwhile. Our attorneys coordinate with your treating physicians, gather detailed evidence of how your condition limits your daily functioning, and prepare you thoroughly for your hearing, whether that’s in Salt Lake City or, for some southern Utah claimants, Las Vegas. You focus on your health. We’ll manage the paperwork and the deadlines.
Contact Social Security Law Group today for a free, no-obligation consultation. We represent disability claimants throughout Utah, including in Salt Lake City, West Valley City, Provo, West Jordan, Orem, Sandy, Ogden, and St. George.
Utah Disability Claim FAQs
Where are Utah disability hearings held?
Almost all Utah claimants are scheduled through the single hearing office in Salt Lake City. One notable exception: claimants in the St. George area, in far southern Utah, are sometimes assigned to the Las Vegas hearing office instead, since that’s geographically closer for many of them.
How long does it take to get a disability hearing in Utah?
Wait times have generally run around seven to eight months from request to hearing, which is somewhat better than in many other states. Even so, it’s worth using that time to make sure your medical records are complete and current.
Is Utah’s approval rate at the hearing stage better than average?
It has tended to run favorably, with a meaningful share of ALJ decisions resulting in fully or partially favorable outcomes. That’s encouraging, but it applies specifically to the hearing stage. Most Utah claimants still see their initial application and reconsideration denied before ever reaching an ALJ.
Why do Utah disability claims get denied?
The most common reasons are incomplete or inconsistent medical documentation, treatment gaps, insufficient work credits for SSDI, or exceeding SSI’s income and resource limits. A denial at the initial or reconsideration stage is typical and doesn’t reflect whether your underlying condition is serious enough to qualify.
What medical conditions qualify for disability in Utah?
There’s no fixed list of automatically qualifying diagnoses. The SSA evaluates how severely a condition, physical or mental, limits your ability to sustain full-time work, and that standard applies the same way across every state.
Should I reapply or appeal after a Utah denial?
Appealing is almost always the stronger option. A new application resets your filing date and can cost you back pay tied to your original claim, while reconsideration or a hearing keeps that original date intact.
Is it worth hiring a disability attorney in Utah?
Given how much weight the ALJ hearing carries in Utah, having an attorney prepare your medical evidence and testimony in advance can meaningfully improve your odds. Our attorneys only get paid if you win, so there’s no upfront cost.
How much does a Utah disability lawyer cost?
Nothing upfront. Our fee is contingency-based, taken only from your back pay if your claim is approved, and capped according to SSA rules (25% of back pay or a maximum cap of $9,200). If we don’t win, you owe nothing.
