Understanding SSDI Benefits
Unlike other government benefits, SSDI is not income-based, so there is no means test. Instead, you will receive benefits if you have a qualifying disability and you have earned enough work credits.
Generally, a disability qualifies if it prevents you from doing substantial work and is expected to last at least a year or result in your death. Some illnesses or disabilities automatically qualify because they are on an approved list of impairments, whereas others require taking a closer look at a person’s limitations. At our firm, we have helped those with physical, mental, and psychological limitations receive SSDI benefits.
Workers also must have enough recent work history. Typically, a person must have earned 40 work credits, with 20 of them earned in the last 10 years. There are exceptions, though, especially for young workers, and the Social Security Administration encourages all of those who think they qualify to apply. Application & Appeal
The application requires quite a bit of personal and medical information, which you should gather ahead of time. You will want to gather information on all medical providers who have treated you and any jobs you have held for the past 15 years.
A person can file for benefits in one of several ways:
- Visit the SSA website and submit information online. This is convenient.
- Call 1-800-772-1213 toll-free. Those hard of hearing or deaf can call 1-800-325-0778.
- Visit one of Massachusetts’s 30 SSA field offices. They are located around the state, including in Boston, Worcester, Salem, and Springfield. Use the SSA Locator to find the field office nearest you.
There is a second program some people qualify for, called Supplemental Security Income, or SSI. Unlike SSDI, this program is need based, but you can apply at the same time as you apply for disability benefits.
SSA states that it takes 3-5 months to get a decision. In many cases, you might need to wait a bit longer, depending on any backlog. Do not be surprised if your application is denied, because most of them are. You can file a Request for Reconsideration with the SSA office within 60 days of receiving your denial letter. If your reconsideration is denied again, you can request a hearing before an administrative law judge (ALJ).
Many people receive benefits from an ALJ after being denied by the SSA office. There are many reasons for this, but one is that an ALJ is empowered to take a holistic view of your limitations to determine if you are sufficiently disabled.
